Yes. That is how I interpret it. I do feel pretty strongly that it won't come to that but it would be nice to have a buyback option in the end.

I got email to register for the settlement and it will be paid out in May and there will be a repair for our 2014 Audi A6 prestige TDI. The payment I will get will range from 8,500 to 8,900 wow! I still love AUDI!

My biggest concern was how any fix would affect performance and fuel economy. The Amended Class Action Settlement Agreement and Release indicates that this is being taken into account Looks like documented defined reduction in performance will cost VW an additional $500, and there is a potential for a Buyback.

Relevant text pasted:
7.5. Reduced Performance. Defendants represent that the Emissions Compliant Repair shall not result in “Reduced Performance.” In the event that the Emissions Compliant Repair causes Reduced Performance of the Eligible Vehicle, Volkswagen shall make an additional payment of $500 for each affected Eligible Vehicle. For purposes of this section, Reduced Performance means a change in any of the following performance attributes: (1) a reduction in calculated fuel economy using the EPA formula of more than 3 MPG; (2) a decrease of greater than 5% in peak horsepower; or (3) a decrease of greater than 5% in peak torque. The performance impacts shall be measured by Volkswagen pursuant to industry standards in connection with its submission of an Emissions Modification Proposal to the EPA and CARB, ....
6.7.3. Generation Two Buyback Option (If Available). Eligible Owners of Generation Two vehicles for which an Emissions Compliant Repair is not timely available can choose to sell their vehicle to Volkswagen in a Buyback and receive a buyback payment that consists of Vehicle Value plus Owner Restitution (together, the “Buyback Amount”), as described in Exhibit 1A ...
Anyway, we're slowly getting closer to some resolution.

The one thing that I don't see is what happens to the 2016 TDI dealer inventory. I hope that they release them for sale.

FYI,

The final court decision for the diesel emission is tomorrow, May 11th! The settlement will begin immediately thereafter. We have a 2014 Audi A6TDI which we love. I looked over the court document and the 2014 Audi A6 TDI Prestige buyback ranges from 56k to 70k which is a lot base on the car's value in fall of 2015. I am considering the new S5 coupe or sportsback as a replacement as I already have a 2016 Audi A7 3.0T in the garage.

Didn't Audi claim that the Gen II TDIs could be fixed with just an ECU update and new cats?

Don't get too excited. We have a long ways to go yet and the buyback only applies if VW/Audi do not come up with an approved fix. There are many hurdles left before a buyback is given to the Gen 2 cars as an option. We will however be seeing Bosches $1,500 fairly soon and also the 50% of the Audi fix settlement amount, roughly $4,500 before the "fix" is done. Stay tuned...

Yes but according to the documents if you have read it you have 2 choices, go for the fix and a lump sum money depending on the car or choose buy back. Eitherway you have 2 options regardless if there is a fix or not. On the other hand GEN I can only be bought back if the customer wants (aka earlier Q7s).

They offer 2 choices regardless if the fix is there for the GEN 2 models, a buyback or repair whichever the owner decides. Take a look at the court documents and you will see that there are 2 columns of payment options.
