It might be less expensive to do the swap, especially if you do it yourself, same with a rebuilt trans, but it all depends on what your time/skills are, not to mention the timeframe.

I had mine rebuilt by a local transmission shop. They used genuine ZF parts for the rebuild, and it was under $3k and came with a 3 yr 30k mile warranty. 50k miles later, it is still rock solid. Call around and see if you can find a reputable shop. I found this one through the preferred Audi independent shop (where most of the local ACNA folks go for work).

So I finally got around to looking at my a6 today I let the car warm up to op. temp pulled it into garage it didn't want to move kinda behaving like it's low on fluid no noise from tranny just don't want to move much til it goes into limp mode. Anyway got it jacked up and level. When I pulled the fill plug I had about a whole quart of fluid come out before it stopped. Is that way too much fluid to come out? And would that ruin a zf transmission?

Was the engine running at the time? The only way to check fluid level in this transmission is for the engine to be running, the trans fluid to be warm, and having been cycled through all forward and reverse ranges. If a full quart came out while running, that's not great. If it happened while not running, that's even worse.. You'll want to fill it correctly. But first, I'd consider dropping the pan, and changing the filter.
Generally speaking, when these are low on fluid, or if they have a clogged filter, they will whine a bit, as they suck air... Overfilling a transmission is almost as bad as underfilling though.

The fluid is black and the car has 215000 on her I bought it about a year ago with 195000 on her for $1800 don't know anything about the service history. Most likly the trans is toast? Want to keep car but repairs will cost more then what I paid for it.

The fluid will be black, it's normal on a car that has driven more than a few thousand miles. It sounds like it is experiencing an electrical type problem.. Might be worth cleaning the connection where the TCU meets up to the trans.
