Interesting, I never knew that about MI insurance. And you're right, it sounds like a BS law. What's the rationale behind it?
When you say insurance costs are ridiculous, out of interest how much roughly are you talking for fully comprehensive in your situation?

Pretty much sums it up. No matter who is at fault; the car owner's insurance pays to fix the car owner's car. If the OP had no collision insurance and his car is totalled, he can get scrap value or part it out and either bike, walk or shake the money tree for another car.
If the other person is at fault, you can sue for a mini-Tort against the other driver for like a whopping $500.00 which is better than nothing.
It is a ****ty regulation for sure. Our rates are ridiculous because of this.

as bad as MI auto insurance rates are, i can first hand tell you they are still significantly cheaper than toronto area rates!!
case in point, my 93 mustang. liability only, in ontario I was paying 140/month, here..80.
now i have full covereage on all the vehicles with a new CO as its even cheaper than just liability thru my old co on all the cars (both MI)..

In Michigan, regardless as to who is at-fault, the individuals insurance policy pays for the repair to the terms of the policy. What many people don't know about our no-fault law, is depending on who is at-fault, the insurance carriers of both parties will negotiate settlements based on percentage of fault. In other words, if both parties are considered 50% at-fault, as determined by the police report, then they split the payout. The insured is usually not even aware of this. In this case it appears the truck driver was 100% at fault then the Audi driver's insurance company would get full restitution for what they end up paying out.

I pay $4550.00 a year for five vehicles (newest a 2008 Jeep and oldest a 2001 Beetle) for basic, minimum legal liability. For my '04 A8, to add collision, with a $1000.00 deductible should an accident be my fault and $500.00 deductible comprehensive (loss from theft, vandalism or stolen car) figure another $1000.00/year. That's only for my A8. I live in Wayne COuNty, the worst in the state.

For me, let's say I still had $1000.00 deductible collision on my A8 (I cancelled that almost 5 years ago) and I wrecked it. I would have paid about $5k in premiums over the time I cancelled it. But if I had it, The car, being so old and with over 250,000 miles would be worth about $4000.00 to them. I'd get a check for $3k.
Not so good a deal.
