Leaking front strut on a brand new H&R coilover kit

Default Leaking front strut on a brand new H&R coilover kit

Purchased brand new set of H&R coilover kit (special ordered from Germany) for my 2012 Audi Q5 which I went through a 3rd party vendor. Two days after installation, I find out that the front left strut is leaking fluid. I just want to get feedback on how to best approach this situation. Also, just found out when I called H&R that the part is currently on back order until May. Yesterday, the 3rd party told me that they have yet to hear back from H&R, but nothing yet. My car is still under factory warranty with only 37K miles.

Questions -

From a safety standpoint, can I safely drive on this strut for the next month or two, until they receive the part?

Should I have my previous strut/spring set up put back until the new part comes in but that'll cost me again around $400 to do.

Anyone know how H&R would deal with this type of warranty claim?

H&R suggested I purchase a new strut from them, then send the old one back. Shouldn't the 3rd party be purchasing this? If H&R determined that it was a manufacture defect, then the 3rd party should refund me for the cost of the new replacement part. Is this the best or only option at this point?

Any feedback is greatly appreciated.
