Default Any stories of APR'd cars that were refused engine/transmission/turbo warranties?

Just wondering if anyone has heard of a dealership denying warranty repairs due to the APR chip. I've heard a few such stories on the BMW forums for people who were chipping their 335's and getting denied warranty claims when a problem arose.

Default It happens. Any upgrade can spike the radar of a dealership....

interestingly, if you have stock mode the dealership has no way at all of seeing your chip, but flashy mods like rims or coilovers can have them suspect you are chipped and just deny a repair. It does happen. Always return your car to stock if you have a powertrain failure.

I've read dozens of posts that it CAN happen, but never a first hand account that a dealer denied warranty because of a chip.

Interesting logic.

Default Nope.

regardless of the performance gains, I like knowing that my warranty won't get voided while I own the car. if I wanted more performance, I would have gotten the S4.

Default Chipping doesn't void your warranty.

I don't know where people keep getting the idea that chipping automatically void's a warranty? Have they not heard of the Magnuson-Moss Act?

<a href="http://www.club-tc.com/forums/general-automotive/515-magnuson-moss-act-vehicle-modifications-warranty.html">http://www.club-tc.com/forums/general-automotive/515-magnuson-moss-act-vehicle-modifications-warranty.html</a>

<a href="http://www.ftc.gov/bcp/conline/pubs/buspubs/warranty.htm">http://www.ftc.gov/bcp/conline/pubs/buspubs/warranty.htm</a>

Long story short, the act basically says that a dealer cannot deny you a warranty claim because of an after-market part. They CAN deny you the claim if they prove that the after-market part is either fully or partially responsible for the issue. In GodBlessQuattro's case, he needs to bring a copy of the act to the dealer and make them prove that the chip caused his 3rd gear transmission issue. If they refuse to prove it, he can take them to court. If they can prove it, he gets nothing. If they can't prove it, he gets it fixed.

Do people get denied warranty work, yes. The question is why? Is it because they didn't know they had rights as a consumer and thus how to work with the dealer, or is it because their aftermarket part really caused the issue they are now trying to get the dealership to fix a problem they created?

Unfortunately I speak from no experience because in three 1.8T's I have never had an issue at all. I do know that if I do ever have an issue and they try to say my warranty is void, I'll come back with the Magnuson-Moss act in hand and show them where it is their responsibility to prove my performance upgrade caused an issue (unless it is a turbo failure, and then I won't even bother, grin.)
