All Audi of AMerica can do is call them and tell tehm not to do it... but they can pretty much do..
Whatever they want. Thats why finding a dealer with a good business plan is very important for a purchase of a car of the magnitude of the R8. Audi was telling the dealers not to sell the R8s to people they fear will flip them. Now go to cars.com and see how many there are. Where do you think those came from. Audi of America has very little to no control over the dealers, sad but true!

How is it that one dealer listed on Cars.com actually has 3 R8's with less than 300 miles on them?
They can't all be dropped by customers?
Maybe he has some really sweet customers like the guy in Philly who traded his R8 in for the A8?

The guys at downtown LA motors wanted $60k over sticker. I told them I would buy it somewhere else in a few years at list and walked down the street and bought an Elise.

What I can tell you is that these were not R8s originally sold by that dealer. How they got them is hard to say. I know Ferrari dealers "report" cars sold to inside people they know and then they sell them over list price 6 months later as used with 200 miles on them. I dont think its the case here since there has not been a daler allocated more than 1-2 R8s this callendar year.

Tell them that if they try and gouge you that you will OUT them here and
anywhere that Audi owners and potential owners check. They can then deal with the bad publicity and the venom that their unscrupulous behavior deserves. They will also need the markup because once Audi knows about them and their hijinks, it will be the last R8 they see an allocation for. Dealerships had to meet certain requirements before they could sell the R8. I'm sure this behavior makes them ineligible.
I picked up my car three months ago (the first delivered in the US no less) and I paid MSRP. I only put down $2,000 about a year and a half ago and received a purchase agreement with no price listed. Not once was I worried that they would gouge me. I bought my R8 from a reputable dealership (Danbury Audi). It kills me how many times a buyer has placed an order and had some "stealership" attempt to rape them.

You have a contract where the agreed price was not open-ended, but was clearly determined! Moreover, as consideration for their (the dealer's) performance, you made a down-payment of $10K. They are trying to change the terms of their agreement. You may want to threaten them and indicate that you are prepared to sue for specific performance.
