Got rear-ended this morning. What would be the best course of action?

Ironic how it happened on the day AFTER the big snow fall. The roads weren't even iced or snowed, just a little wet.

Anyways, the guy was following too closely behind me at an intersection while I was waiting to turn right. I made a full stop, and he hit me almost immediately after I had stopped.

I got all his info. Didn't report it to the cops yet. The damage doesn't look that bad, aesthetically the rear bumper has about an 8-10 inch scratch. It didn't seem like I was hit that hard, but could there be damage behind the bumper?

What should I do now, should I report it? I don't necessarily want to go through insurance if I don't have to. I need to get a couple quotes and then get back to the guy.

Suggestions?

Carmine_S4 11-23-2007 06:50 AM

It's 100% not your fault...report it.....you're going to give him a couple of quotes,

he's going to fall over that a new bumper costs $1500, and then you're stuck.

Audi Advocate 11-23-2007 06:50 AM

Call him right away and suggest cash - and get those 2 quotes

No need to report it if he'll pay out of pocket.

If he wants to go through insurance you'll have to get a damage report - pain in the ass.

If it's not major he'll probably want to do cash. Its unklikely that he damaged any more than your bumper cover but the shop will know for sure!

May I suggest Don Valley Volkswagen collision - top notch work - all luxury makes - have done my Audi's/VW's for years.

Good Luck!

Meegis 11-23-2007 06:52 AM

Make sure that the guy is on the level...

If you do not report it within a certain amount of time (i forget, but its like 24 hours i think) than basically the guy is free to go.

I also do not think that acciedent reporting centres issue statements to insurance, but again, I could be wrong.

Ryan in T.O. 11-23-2007 06:54 AM

That sucks. I hope you're ok. If you got rear ended, the other guy is 100% at fault. I got rear

ended twice for $25k worth of total damage and my insurance actually went down. I'd be real careful about not going through insurance. At the scene, people say all kinds of things and promise to pay for everything. Then once they think about it a little more and realize the cost of paying for both your car and theirs, they start to play games. I've seen too many people get screwed just because they tried to help someone else out.

Call Louie at Automotive Legends 905-882-6353. Tell him Ryan with the black audi sent you. He does excellent work but it does take a while. He fixed my car both times.

Hobag 11-23-2007 06:55 AM

So I should report it? As in I should report it to the police?

Hobag 11-23-2007 06:59 AM

Thanks for the info. But isn't it no-fault insurance? I'm not sure how that works exactly...

but doesn't that affect both our insurance if either one of us go through insurance?

I'm fine btw, just a bang and a quick jolt. *that's what she said*

maaliish 11-23-2007 06:59 AM

I wouldn't report it so long as I'm sure the guy will pay. Get a repair quote and his money ASAP.

If you're encountering any problems, report it.

Hobag 11-23-2007 07:03 AM

Well I don't want to suggest an amount until I know how much it's actually going to cost...

to fix it. He also seems to be familiar with this stuff, because when I said I need to get a few quotes, he suggested his body shop over on Midwest. Roop Auto I believe.

My body shop is also on Midwest, so I was thinking about getting quotes from both of them.

SMO 11-23-2007 07:19 AM

I'm pretty sure you only have 48 hrs to report it. If you are going to negotiate with him first....

then make sure you have the cash before your deadline is up.

I'm also pretty sure your insurance will go up if you report it. I would:
1) Call your insurance co and ask them if it affects you,
2) Go to an Audi shop immediately (if you can) and have it inspected to see if you have bumper damage
3) If it's not a big deal repair, get cash from him right away. You can fix a scratch probably for $100. If it's just a scratch, it's definitely not worth going through insurance, because I think both of your insurance prices will go up!

SMO 11-23-2007 07:21 AM

If you want a quick and cheap repair, I had a portion of my bumper repainted for $125...

Guy came to my house and did it in my driveway. Probably won't happen now in this weather, but he's very reasonable. I posted his info a while ago, let me know if you want it again.

Hobag 11-23-2007 07:32 AM

But if I report it to the police, does that necessarily mean it gets reported to my insurance?

I just don't want to get screwed for some technical bs.

DeMOROlized 11-23-2007 07:34 AM

Here's what "no-fault" actually means in Ontario.

First of all, fault IS assigned.

The "no fault" part just means that whether you are at fault or not, you deal with your own insurance company instead of the insurance company of the person at fault.

More details on what no-fault insurance is.

RippleChip 11-23-2007 07:42 AM

Collision Center. Police dont' want to know about it with low value damage.

Hobag 11-23-2007 07:46 AM

Yes that's fine. But is Collision Center / police independent of my insurance?

SMO 11-23-2007 07:49 AM

No, I don't think so. Once you report it, your insurance company will find.. will be there for 7 yrs

GregC6A6 11-23-2007 07:49 AM

I was rearended last summer....father paid for his daughters mistake...

My bumper had two big divots from the screws of her license plate and some scratches. I ended up going to an AUDI shop in brampton and it cost the guy near $800. There was no way I was going to go for a cheapie file and partial respray job when I wasn't the one at fault. He paid no problem. I made sure I took her license plate and insurance right after the collision.

GregC6A6 11-23-2007 07:50 AM

why go cheap when he is not the one at fault???

SMO 11-23-2007 08:39 AM

True, but why pay $700 for a $125 repair?

405Z 11-23-2007 08:47 AM

technically, you're supposed to report it

your insurance will not go up as it is 100% his fault. If you report it, his will likely go up which defeats the purpose of him paying for it out of pocket. I think you're supposed to report it within 24 or 48 hours (can't recall which one).

Hobag 11-23-2007 08:56 AM

Thanks, that's good info.

GregC6A6 11-23-2007 09:28 AM

if you can guarantee that I won't look at my bumper after a good wash and see the difference then...

no problem, but generally, partial sprays are just a quick fix that you notice.

SMO 11-23-2007 09:44 AM

Since I'm not the one painting it, I unfortunately guarantee nothing!

DB/S4 11-23-2007 09:47 AM

Ouch. Sorry to hear, dude... I'm always paranoid it's going to happen to me. [knock-on-wood]

jason in toronto 11-23-2007 10:03 AM

if u are hit from the rear it's 100% the other guys fault

jkwan 11-23-2007 10:10 AM

Any nice B5 S4 rear bumper/valence mods available? :)

j/k. sort of.

Definitely determine what type of damage has been done and if it's just aesthetics, probably not worth going through insurance, as some have mentioned.

FYI, from my brother's experience going the cheaper spray over solution from Maaco, it is clearly not as well painted as the factory paint job. Duller top coat finish and you can see spray pattern/blotches.

Ed@mtl 11-23-2007 10:11 AM

Sorry to hear. I hate those kind of accidents, getting rear ended.

Hobag 11-23-2007 10:32 AM

No mods for the rear...unless I go widebody. Hmmm....

eh-4Q1.8 11-23-2007 10:52 AM

Call the rape-crisis hotline

Bruno_S4 11-23-2007 10:53 AM

That sucks Hobag. Get a couple of quotes and go to Pfaff. They did a great job on my rear end : )

Hobag 11-23-2007 11:04 AM

Ah, where would we be without the rear-end jokes.

afretes 11-23-2007 11:41 AM

LOL!

Carmine_S4 11-23-2007 12:24 PM

Dammit...I can't believe it took almost a day! I'll have to do the deed: Last one for Hobag WW

too easy...

Aman_UnatrlyAspiratd 11-23-2007 04:09 PM

****, sorry to hear man. Hate dumb drivers.

northof49(+1+1) 11-23-2007 04:39 PM

my take

happened to me recently. took his info etc. then took it to a body shop that knows audis. there are two shocks behind the bumper that "blow" on impact. if they are broken then it gets expensive my quote was 1300.00. so the police report has to be done if over 1000.00 (alberta). did this. police said other driver has to report as well, called told him to file a report. then he can decide if he wants to go insurance route or cash to pay for your damages.

koz4.2 11-23-2007 07:25 PM

Because you get what you pay for... Why should he be doing favors for the guy who hit him?

koz4.2 11-23-2007 07:34 PM

Report it. Let insurance handle it...

It was clearly not your fault, so your insurance will not go up. If you leave it too late, you loose all your leverage, and things could get messy. You don't owe anyone any favors, but look at it this way. Your insurance won't go up, and, unless the other guy files a claim for damage to his car, his insurance will probably be unaffected as well. Good luck.

Koz.

JScottC 11-24-2007 07:15 AM

2nd. Also, have it inspected.

I once was in an accident and thought that there was only minor damage, but quite a while later discovered that there was more damage, that had not been visible, and it cost me way more $$ than I first thought. Since he's clearly at fault, you have nothing to lose by going through your insurance.
