it's fraud...
you sign a rental agreement that prohibits what you are doing and then you do it...you are defrauding the rental agency by causing excessive wear and tear on the car despite signing an agreement that you are not going to do that. Also, people have balled up rental cars then had them towed out onto the street and tried to claim they had an accident that the rental agency has to cover under the supplemental insurance...fraud is illegal.
Rental agencies aren't quite as stupid as people suppose and SOME agencies actually have tell-tales which track the cars speed etc.
I avoid riding in other people's cars at the track after being bounced off of walls a few times but would love to take you for a ride some weekend where we have time to put a passenger's seat back in (we usually bring it with us). Wouldn't dream of driving someone elses car on the track because I wouldn't want the liability if something went wrong (same reason I don't track my own street car).
Why on earth are you tracking an automatic? 1/2 the fun is heel and toeing!

True, which would subject you to civil liability for fraud. A DA could theoretically prosecute but..
never would. They would tell Enterprise to take the guy to court.

Why the automatic?
Not by choice really. It's the only car I had when I did my first event a year and a half ago. Didn't know when I bought the 330i I'd be doing anything like this.
At any rate, I'll be getting a real track car ... sooner rather than later I hope. Thinking along the lines of an E36 M3 or Spec Miata.

Those guys get screwed enough...it's amazing how many people rent cars and don't even bring them back!
Since a large part of his salary is dependent on profitability...if I screwed the rental company, I'd indirectly be screwing up my own racing program!

It's not controversy I seek...but the competition...
It's a good part of why I love this hobby so much. And the reason I'll be involved in wheel-to-wheel racing very soon.

I am a lawyer and splitting hairs just for fun. I would never expect you to 1) take him up on his bet and 2) drive a rental car on the track.
