I doubt that would hold up.
If the transponder fails, then it will they just keep deducting the charges from your account. If it continues to fail, I think they would just send you a replacement transponder.
The reason to register with FasTrak is a backup incase the transponder fails. Otherwise, some monkey has to look at license plate numbers all day long.
