Default I got one of these once as a NYer in PA a few years back . I'm pretty sure...

it was just a money making thing for them.

It was something like $100 but no points on my license since it was "not a speeding ticket" (though I was speeding).

I don't remember if the speed and limit were on the ticket, though.

Default You're drawing conclusions with no legal basis.

Yes, it makes sense that if the state is allowed to post a sign indicating the speed limit, and he exceeded the posted speed on that sign, he was speeding.

This isn't about common sense, it's about the law. And if they are going to charge him with violating the law, he needs to look up the exact wording of the statute he is accused of violating. As far as I'm able to see, the state has established a fine schedule based on this law, however this statute makes NO mention about motorists obeying those posted signs, it only grants the state commission authority to post relevant signs.

As far as which statutes will constitute a moving violation, that should be spelled out in a document published by the state. It's a black and white question...either the statute is listed in that document as a moving violation, or it's not.

Default That's why there *should* be a subsection to define the actual infraction..

...either the officer purposely left it out, or they do things really weird in that town.
