that's an intresting take on it. not that i can't see it happening...although it should be a side to side thing(ESP). traction control, which still operates independantly, makes sense.

it does not go away with esp off; i have complained to niello and they told me i was lugging it in going from 6th to 4th and they told me i needed to go to 3rd instead. quite frankly, its bull$hit. something is wrong, and i'm sure it willl take another month via passenger pigeon from germany to figure it out.

Go around the dealer.
Also, find another RS4 owner in the area that is willing to let you do a drive along. Have him ride with you when the power drop happens and then have him drive his car in the same way. An A-B compare might be the only way to convince the dealer tech.
When cgthanos had his DRC repaired, he thought it felt wrong. (He'd been driving with a blown shock for a while, and after the repair it took some time for the hydraulics to equalize from front to rear.) I met him at the dealer and drove his car to compare. Turned out it felt and handled normally. But had their been a difference, it would have taken a few more minutes to convince the service tech.
