Nice pictures huh? Well after leaving my girlfriends place this morning I approached a 4 way intersection which is not controlled by a traffic light.
I was trying to cross the intersection which has a pedestrian crosswalk which runs parallel to my route through the intersection.
There is a single lane for traffic coming from my left (travelling north) although nobody was coming from that direction. There are two lanes coming from my right (travelling south) although after 9 am the lane closest to the curb is for metered parking. The lane closest to me has about four or five cars stopped yielding to myself and another driver. The metered lane is not visible from my vantage point.
Well...as I mentioned, there was no oncoming traffic travelling north, it was clear and like I said the cars travelling south in the lane closest to me stopped to let a car on the other side of the street make a left, and to let me cross as though I was a pedestrian...there were four or five cars in a row sopped to let the traffic cross because about 50 yards ahead there is a controlled intersection, the light was red and they had no place to go.
The car across from me made his left in front of me and then I proceeded to cros the intersection. I assumed the metered lane was clear because of the car that made a left before me. As soon as I paseed the cars which were yielding to let me cross I enter the next lane and BOOM! Bullseye....I don't even think I heard her brake.
As soon as we pull over I ask the lady if she is okay...she says her leg kinda hurts from the steering wheel. I ask her why she didn't stop like the rest of the oncoming traffic...didn't you see the traffic stop to yield two cars crossing the intersection? I said if I were a pedestrian I would have been killed. She says that it is my fault. At that moment I am so mad my **** is boiling but I contain myself and all of a sudden a woman in a benz pulls up and asks if we are okay. We both say yes...she hands me her card says she is in a rush but saw everything. She says she has a meeting in a restaraunt down the street and she should be there for a while.
After the police come and do absolutely nothing...i go to the restaraunt and the woman says that the person who had hit me had been driving erratically for a few miles and was speed ing when she hit me nd had almost side swiped her beanz. She also said the Plymouth had failed to yield like the other cars but I would have a tough time proving she was at fault. I asked if I could use her as a witness and she said absolutely....I think her testimony will take care of proving who is at fault.
What do you all think?
Man this is no way to start a Tuesday morning!!!!

you don't pay them a gazillion dollars a year for nothing.
I'd also suspect you are going to see a lawsuit for that ladies "injured" leg.
Be sure to get the police report (such as it is) so that you have all the paper work AND any comments about the "injuries".
Also write your own complete report (like you did here) while it's fresh and try to remember any and all details so you are preared later.
THEN look up the vehicle code...if there are two lanes of traffic and ONE CAR stops to yield to crossing traffic, the other lane HAS TO STOP next to the car that's yielding.
Sorry dude, good luck on this. Unfortunately nobody ever comes out "ahead" from an accident and one is lucky to get their car back with a minimum of hassle.
