Carl has been trackin since the mid 80s..I think he might have some suggestions. I wasnt suggesting using him as counsel.

reggie..there are numerous problems with cars on track that involve insurance companies.
I am sure this isnt the first time an insurance company is denying a claim. Open lapping days are different than instructional events.
The level of risk increases in the following order:
1) Car control clinics (like BMW has..with instructor, helmets, and relatively low speeds..and usually no walls to hit)
2) Autocross events (timed, but nothing to hit)
3) Driver Safety Seminars (like Audi Club has). With car control exercises and instructors for all students. Or Driving schools like BMW club has...where even the most experience groups have instructors..and a real strict (no 2 or 4 wheels off the track policy)
4) HPDE - Like NASA/Northern California Racing Club and Hooked on Driving. Where there are higher groups with passing anywhere on the track..even in corners with or without point by signals from driver being passed.
5) Open track days with no instruction
6) Time Trials - NASA and Touring Car Club does these..as does Northern California Racing Club and other groups. This is a TIMED event..with or without cars on the track with you. You are not being instructed..you are tryin to drive as fast as you can in a competition timed environment.

technically and legally, probably nothing
but having driven in a MMP open track day, SCCA PDX/Club Trials, and ACNA DE; the MMP open track day was the one I most frightened for my safety and the safety of my car.

Hate to say it, but you're hosed
Almost all the insurance policies have exclusions for events held on "high speed surfaces". Covering an accident on the track is totally up to their discretion.
