I called Irish Mike's yesterday and here is what happened....
 
I asked for the General Manager, his name is Mark. I said look Mark you guys have now seen my car 4 times. The first time for the original oil problem. You fixed that problem and I drove away with 2 problems. My car has now been in 3 times over a period of 1 month to have these new problems fixed and each time I drive away with my car in the same state.

I said I'm done bringing my car in to let your shop worker's play games on it.

He said all we did was fix an oil leak and a timing belt change it's not like this is some car we've never done this too before.

I said oh really I find that interesting. The service writer told me the job was unique and a $400 tool had to be ordered.

Silence

He finally says ok bring in your car and we'll talk about this.

I said no were talking about it now. I'm not bringing my car back there like it's a toy and we'll just play around with it. It's a $40k car that feels and sounds like a pos. You had your chance it's time to move on to how you're going to compensate me.

He said what would you like me to do?

I said I paid $2,732.60. Worse yet I paid after the test drive from the initial repairs reported back that the car was in perfect condition. I drive away from the lot only to find that my car is not in fact in perfect condition and I've just paid all of this money. I call back the next day and the service writer seems happy to take care of everything. We all know what happened from there. I kept coming back. First time they did nothing. Second time they did nothing and ordered a rubber grommet that was on backorder. Third time they install the rubber grommet, which did nothing. That leaves me here today out $2,732.60 and with a car not running how it should. I said I asking for $889.20, which is the full amount of labor charged on the job. I said parts were all necessary and signed off by me and are in my car, so I am not asking a refund on them. However, the labor performed left my car broken and not fixable, "by you", and as such I need the refund to make up for lost time and frustration, as well as for a job not well done, and lastly to pay someone else to find the problem and correct the problem.

He says we did what we were billed to do and we did it right and we will not give you a refund.

I said if you did your job right, why did I bring my car in 4 times and have it not right?

He says I don't know, but I'm offering for you to come back in and we'll look at it.

I said no I will not bring my car back in and if you're not prepared to offer me a refund I will be taking this to the next level. Are you sure you want to go there?

He said with an attitude please do and he slammed down the phone.

I started with the BBB. I know they're worthless, but at least it puts a formal complaint out on them. That process takes 8-12 weeks to complete. After that if there is no resolution (there won't be), I will consider if it's worth my time to take them to court, or just let it go.

They do not sound like a reputable shop. I feel for you.

D@mn, that svcks. What about your local Rev and Tax? That shop has a business license...
 
couldn't you file a complaint with them for unfair business practice? Or is that the sole purpose of BBB? Are you a member of ACNA? They've helped me out of a couple of disputes, perhaps they're another resource you can use?

I have a feeling you'll need to seek legal council to get anywhere, at which point this will probably come down to a decision of what its worth to you to pursue it further. My guess is, you'll spend more on lawyer/court fees and time than the $900 in labor to get it rectified, but maybe you can get them for damages in these amounts if you go to court and win. I dunno.
