OT - Need help on getting refund of deposit!!!
Sorry this is off topic, but I figure with the number of smart people on this board, someone can help.
My brother has a charter bus business. He went to a bus dealer and gave him a deposit for $1000. The bus dealer took a couple of weeks and could not get my brother financing.
My brother subsequently went to another dealer and bought a bus with a co-signer. Now the original delear (pissed) has refused to issue my brother a refund of the deposit and has even sent him a bill for "Consulting fee - Bus purchase - Time spent to locate new bus & work on financing."
No contracts nor sales agreements were signed. Never was it mentioned that the salesperson was working for fees rather than commissions.
Suggestions on a proper course of action? We are in California. I think the law would be on my brother's side.
