My car stolen from an Audi Dealer!! Need help and advise!

Default My car stolen from an Audi Dealer!! Need help and advise!

Hello!
Please read even it's too long and please help me or give me some advise.
I left my 97 A4 2.8 at Miramar Audi in San Diego for maintenance on Monday(9-24). Today, 9-26, some unknown person called my home and told me that he found my car on a street and he's keeping it safe for me until I pick it up. So, I called the dealer(Miramar Audi) and ask them if they were aware of it. They said they will check and call me back. 3 minutes later, the advisor called me back saying that they lost my car. They didn't even know my car was stolen until I told them. The service manager told me to go to Police Dep. and file a report. So, I went to Police Dep. and gave out all information about the guy who called me and how the car was stolen. One of the officer told me that actually I'm not the one suppose to report the lost since it was stolen from the dealer, and they are suppose to report the lost and be resposible for.
Finally I did get my car back and the thief was the person who called me. The car was stolen directly from the dealer and the car door was open with key in the car. The thief drove my car for almost 300 miles but nothing was missing or damaged except minor scratches and some coins. Detective told me that I need to report this to Business Bureau, Auto Repair Bureau and get an attorny to sue the dealer so they can do something for me even the work order(the dealer's policy) says they are not resposible for lost or stolen. When I talked to service manager of Miramar Audi on the phone, he told me that they are not responsible for the stolen because it's just exactly as same as getting a car stolen from a Vons Market. I was so mad but I didn't know what to do or to say. I went over to the dealer with my found car to talk in person. When the manager saw me, he told me that he will pay for the cost of maintenance which cost $115. So, I just left my car there again and went back home.
Do you think I shall ask for more? Do you think I still need to report this to Bureau? But if I report it to Bureau, what can they do?
I really need some advise on this I'll really appreciate any advise.

1. Make sure the owner of the dealership knows about this service manager. See what he has to say, he should be the ultimate decision maker.

2. If that doesn't work call Audi of America and let them know what this service manager told you.

3. Is there another dealer around you? If so I would take your car there from now on, it sounds like these guys are real jackasses.

4. I would make sure they repair any damage in or on the car. Hell, I'd even ask for my 25cents back - it's the principal of the matter!

Was it actually on their lot when this happened or was it on the street?

Default Tell the guy it's not the same as stolen from Vons...

Ask the dealer what happens if you bring a Rolex to a jeweler for repair and it was stolen. Their insurance should cover it!!!

Default My BMW was damaged at the dealer.

My brand new BMW 740il got a tool cart slamed into it. I was way pissed off, called everybody, but in the end all I got was the car repaired and a loaner while they did the repair (it took about a month). It is their insurance that covers it not yours, it is not the same as if the car was stolen off the street. However, they will never be required to pay for anything other than damage. Since the car was recovered, they don't have to pay anything simply because the car was stolen off their lot. The offer to pay for the service is probably the best you are going to get.

Remind him that you don't give your keys to the bagboy at Vons. Seeing that your keys were found in the car, they are to be held responsible and were negligent in safe guarding your keys and your car. I would not stop at the owner, go all the way to the top, AOA. Write a letter and CC the entire chain including the better business.....good luck

Default Do you have another choice for service?

If so, I would call the local TV news stations and give them your story.

Unfortunately the service from Audi dealers is so uniformly terrible that nothing will improve until non-AUdi owners find out about it.

Default A bailment was created...

once you turned the keys (and control) of the vehicle over to the dealer (same thing at valet parking). Their disclaimers are worthless. They are responsible under the law of most jurisdictions (including Calif.). Several years ago, our Volvo's radio was ripped off at the dealer. When they tried the same argument, I slapped them silly in court. However--your damages are minimal at this juncture. Write letters (better yet, retain counsel to do so). Why yes, I am an attorney.

Thats really brutal that it had to happen to you. You are of course lucky that nothing else happened to your car, so i think you should be happy nothing worse happened, althought its not my car that it happened to so i probably shoudlnt talk about what to do. By the sounds of it you could really screw over the people at your dealership, but if you don't, they would definitely owe you something so the next time you wanted to take your car back there, they might be nicer..and perhaps do you a favor..maybe give u a nice loaner car or anything at all. Having a dealer happy with you wouldnt be a bad thing
