Default "Lifetime fluid" claim from 5-7 years ago to blame for now failing trannies... class action suit?

I'm thinking that with all the people on here whose trannies are failing, it seems to me that a class action suit is on the brink? I mean, it was AoA's claims in the late 90's that the fluid never needed to be changed which allowed the fluid to get so bad that the trannies self-destructed at around 100k miles (which is way early by any companies standards). Who would be game for a class action suit? I am an attorney with some free time on my hands. Never done a class action suit before, but there's a first for everything. I think now that we've determined what failed and why, it's about time AoA offers to fix the damage their overzealous and blatantly false advertising has caused.

It would only cover 98 and later. 97 owners manuals said it was to be changed at 60(?)k miles?

Default Double-check your manual. I remember PaulW talking about this at one point. Wife has my A8 now...

so I can't check until tonight.

Default Hrm, I have all the service records from the PO.

He brought it in religiously for each scheduled maintenance. I will see if at 60k they changed the fluid when he brought it in. If not, then their failure to do so could be cause of my failure.

It may say it in the 97 manual but dealers refuse to do it anyway. It is lifetime remeber

Than that specific dealer would be responsible? Not following their own mandate (manual)?

Default That's my theory..

Tom Woods Audi sold the car in '97. The PO brought it in routinely. At 60k if they were supposed to change the tranny fluid (per owners manual) but didn't, then the "failed tranny diagnosis" at 90k miles (again by them) would be a result of their negligence. Best part is this is a simple small claims suit ($6k cap, plenty to get the tranny fixed), not a messy class action. Woo hoo, I'm going to check that out tonight!

Default I don't think you will prove the case.

The evidence that the fluid cased the failure is not that strong.

Default I forgot you were in Indy, too. My A8 was hatched at Tom Wood and has stickers for service...

through 100k. After that the 3rd owner took it to an independant shop where they did TB and Water Pump before I got it. At 115K-ish I did the transmission fluid myself.

I wonder if they'll honor the recall for the control arms for me.
