Going to courTT (revisited and long)
Going to court because some stupid woman tried to launch her shopping cart into the parking lot "cart pen" from 35 feet away, missing everything but my right headlight, putting three nice scratches/gouges in the Lexan! While I was sitting in the car! She then had the nerve to try to leave!!! I had to push the cart up behind her car to keep her from driving away! THEN she gives me **** like "Those aren't the only scratches that car will ever get", and "That could happen from stones on the road!". Finally, after saying she didn't "know why I was so upset", I said (amongst other more reserved and obvious things like "stones on the highway aren't negligent and can't buy me a new headlight"), "well maybe if I drove an Escort like you, I wouldn't be so upset!" She freaked, and at that point, she called the cops on me!! Police as witness to her screw up! Loved it!
This kind of thing isn't covered under her auto insurance, it's under personal liability on her homeowners policy, which after a legal letter with threat of lawsuit she still didn't give up the claim information on!
So in the morning, with my parking lot diagram, incident info from the deputy, and estimate of the $1200+ repair from Audi, we are going to court!! Can't wait to see her defense in this.

This woman was a piece of work! After I carefully explain to the Judge what happened, and saying that she tried to leave the scene because she didn't know I was sitting in the car, the Judge asks me, "What do you want in this suit?" I told her I'd like judgement for recovery of the cost of replacing the headlight unit, as well as court costs, for a total of $1308.
Judge: "Ma'am, is the way the plaintiff described the events accurate?"
Defenseless Defentant: "Yes."
Judge: "Is his diagram of the events accurate?"
Clueless: "Yes."
Judge: "Did you push the cart from 35 feet away, and strike his car?"
Dimwit: "Yes."
Judge: "Did it scratch the car's headlight cover?"
Whacko: "Yes."
Judge: "What do you want from this suit?
Loser: "I just don't think I should have to pay! The deputy said he thought it might be able to be buffed out!"
I almost laughed out loud, before saying that I don't consider a police deputy an expert in auto body repair. I then showed the Judge a letter from Audi stating that buffing the headlight is NOT recommended for a variety of reasons.
Then the Judge asks me if I only had the one estimate. Yes, I explained, I want the car fixed by Audi. She then says she has to review some stuff and she will make a ruling at 2:00pm (yesterday). I call the courthouse at 2:00 and am told that the Judge has asked for me to supply her with two more estimates, and then she will render a decision.So I scramble around in the car and on the phone, and end up with one estimate that is $26 cheaper, and one from the other Audi dealer in town (via fax), that is $138 higher! I submitted them to her this morning, along with a letter asking her to consider the original middle bid, because I don't really want a low bid mechanic (who has never seen a TT, let alone worked on one) taking apart my car!
Needless to say, the Judge ruled in my favor, <i>and</i> with the bid amount I had requested! What a royal pain in the ***....all because some ignoramus doesn't want to take responsibility for her actions.
Now to collect.
