Default Why it sucks to live in Canada.... for all those who have been following my posts about my car

today I found out after talking to my lawyer, the APA (automobile protection agency) and another consumers right group up here...... that even though my car hasnt been fixed and is still broken and the factory is unable to acertain the cause of the problem that it will be virtually impossible under Canadian law to have it "lemoned" I was also informed by Audi of America that should I contact legal assistance on the matter that they will in effect close my file.... that is they will cease to have anymore dealings with me period in regards to fixing my car.... So the only option that is available is to enter into a legally binding arbitration process with an agency that is paid for by the manufacturere.... all arbitrations are up to the arbitrator and are never based on precedents or other mitigating legal factors...if I enter into this process I in effect sign a contract where by I loose my legal rights to sue AUdi should the arbitrator disagree with my claim... ALso apparently you are only allowed to have an arbitration against a defect once.... what his means is that if for example they decide my turbo and cooling system is defective and force Audi to fix it.... should it break down again the factory is no longer obligated to re-fix this problem....oh yeah you gotta love it... also they told me that vehicles in Canada are never lemoned where by the factory gives you a new vehicle and agrees to take back your old one...instead the only option would be a buy back based on a seriously deflated price due to my high mileage (17K kms) yeah.... thats tons of mileage....Car was purchased new in March..... so now i have a car sitting in my Garage that has a coolant system full of oil a bad turbo and possible head damage ....but I have very little recourse.. I have looked into the possiblity of selling my car privately..... but do to the problems it seems that up here that the TTs do not hold their value well... so if I sell it I will loose a sustantial amount of money.... Oh yeah one last thing any buy back at the defalted value through arbitration doesnt cover things such as the Bose 6 pack CD sytem, Audi Phone and upgraded wheel package.... so they in effect do not buy back any factory options just calculate a deflated value based on your base vehicle regardless of what options you have installed..... I think I might move to the US and try the warranty system down there...... unbelievable how nasty and vicious and unprofessional AUdi of America is.....

Default I don't know anything about Canadian law, but the threat to "close your file"

sounds like a good old American scare tactic.

However, I know that my manual addendum in the US does outline the arbitration process to settle disputes. I always assumed that is what happens when you go through the lemon process here, is that the arbitrator decides the outcome. In some cases AoA just bites the bullet (no pun intended) and gives someone a new car to save P.R. face. Am I smoking Keroppi crack on this one?

Default Agreed...but read the small print in the front.. "says does not apply in Canada" also

as part of our owners manual package up here we get sa small blue booklet outlining the warranty rights.... In the US you guys enjoy a really good system of consumer protection.... makes it easy depending on what state you live in to lemon the car.... not so up here... I thought this was the case..but until I checked I didnt know how little right s I actually had....as to the threat to close my account...its the second time theyve done it.... typical push tactic.... but doesnt inpire much brand loyalty.... I really like Audis in general... from both style and performance...... but I will never ever ever give this corporation any more of my money..... thinking about setting up a website...similar to "donotbuyabmw.com" where people can list their negative experieinces and gripes against AOA.... I think that they will only listen if they loose sales.... becasue frankly do to the size of their corporation they really dont care whether they keep my business or your business.... typical bloated goat mentality...
