Legality question on a ticket....
Lets say a cop catchs someone going over 80 on a city street, no radar just knows because his car shook back and forth. Writes a ticket for stop sign violation instead. This person pleads not guilty on the stop sign ticket, the ticket gets sent back saying hes to go to court to fight it now. If the cop shows....can he give you the ticket/fine/arrest you were supposed to get? Or is worst case scenario cop says wow your an idiot and prosecutor says go pay the fine and be happy he let u off.

pretty simple question....
its a pretty easy question for somone who has experience i saw a thread on speeding before and there were a few guys that seemed they would know...my guess is if he didnt ticket me then, he cant do it at a later date just because he wants to.

thank you, yes i know its standard just wanted to make sure i didnt screw myself while trying to get away with nothing. im at rest now...phew

actually...
a cop can write you a ticket for anything as long as its within the statute of limitations, which I believe is 3-4 years for most things. A cop can even write you a ticket for something you didn't do if he wants to, its up to you to prove you didn't.

But courts tend to side w/officers. Frankly, it's stupid to fight the ticket...
for the stop sign violation. I can't see how someone wouldn't be thankful they didn't get cited for the speeding. This "person" has some real gaul thinking they should be let off for everything. It is possible he could bring it up in an effort to seal you fate for a fine for the stop sign violation. I figure he would probably say something like, "your honor, I stopped this individual for for a stop sign violation and he was speeding. I gave him a break and only cited him for the stop sign violation. Bottom line, it's going to be his word against yours. Courts rarely make an example out of the officer. Usually it's the driver that gets made the example out of.
