Has anyone tried to have their dealer order the DBW update yet?

Im going in for the third time about it....
My instructor at the track said there is on reason it should perform the way it was. This will be the third time it will be in for the DBW. By PA Lemon Law, 3 times for any one problem in the first year constitutes a Lemon. im gonna make sure thats in the back of the heads of the Dealer before they say its normal.

You have to understand that the DBW programming IS normal.
So the Lemon Law does not apply. The basic function of the DBW program is to soften the impact of a quick wide-open throttle request, and it accomplishes this task very well. It is annoying and maybe even a little unsafe, but it is normal.
There is a fix that I am working on and have made posts regarding though (see sig). The part I need is arriving via FedEx today and I will post the results.

Yea but audi could void your warrenty for doing something like that...
I would just assume buy a chip that fixes the throttle map instead of hack my car up. Having talked to tuners and talked to people who have, our throttle program is a mess. No other way to look at it.

Sure Audi could void my warranty, but that's a small risk I'm willing to take because...
...I'd be surprised if an Audi Lawyer could tell a judge, "yes Your Honor, we've designed a DBW program that ignores, for half a second, the driver's request to open and close the throttle."
I know that last week I told you that litigation should be avoided at all costs, so you're welcome to call me a hypocrite, but I feel the risk of it is very, very small here.
Also this part that I ordered will be a plug-and-play device; simply unplug the clutch pedal's "home" sensor and replace it with this. It does not reprogram anything; it simply tells the car to use only one of its two throttle maps instead of switching back and forth.
It is less likely to void my warranty than a chip, that's for sure! Also, this part costs $11 with shipping.

I just called my parts departement. They tried the part number but said it comes up with nothing...
They said it appears to be a valid part number, there is just nothing in the database for it. I would guess its a euro part number, no?
