Default Order Problems- Help!

I've recently worked out a deal to order a 99.5 A4 for 1000.00 over invoice (gave a 200.00 deposit), but my salesman has recently informed me that he has been unable to find a car through other dealer's allocations, or some method to speed up the delivery??? He will find out if he will be allocated one from Audi tomorrow. He said, "I can give you some other dealer names to try and get one if I'm not given an allocation tomorrow". Well, that pissed me off a little since we've already written out the agreement, and I feel that I've received a fair deal. At this point I'm not sure what to think. Should I demand that he get me a car that we agreed on? Can I legally hold him to this agreement? What happens if it takes longer than anticipated? He says 100 days or 4 months away with a new allocation. Anything else that you all think I should try to be aware of? Thank you for your help.

Default You are justifiably frustrated but I don't think you have legal gorunds (more)

<br>I'm no lawyer so my advice is worth what you paid...<p>I sense that A4's are extremely popular cars regardless of region. Sometimes it's tough for the dealer to find exactly what you need. If you aren't willing to order from the factory (and wait), you might have to make a compromise in terms of colors or options. When I went to find my "perfect" car, it didn't exist ANYWHERE! I stopped at several dealers and each confirmed that the car did not exist in North America. So I decided to order and take my chances. Even after my car was produced, it was the only one of its kind in North America. (I guess I chose an odd color/ options combo).<p>$1k over invoice seems like a healthy (though fair) profit margin for the dealer. Hence, I find it unlikely that your dealer is actively trying to break the sale for fear of low returns on sales effort. <p>Putting a deposit down on a car does not seem binding to you or the dealer. I'd check the other dealers in the area. You may have better luck getting an ealier allocation from some place else. In the end, just let the other dealers know that you are serious about buying. Let them know that they can make a quick 10 minute sale if they can produce the goods within the $1000k over invoice price. <p>The alternative is that you make a compromise in terms of color/options. I meant $1k over invoice, $1000k over invoice would be a heluva profit margin.
