Default Anyone had any luck in suing city for pothole damage

I just hit a pothole as large as a 20in rim @ 55 mph. I now have blisters in both tires and 2 bent rims.
I hate Chicago.

Default South Bend wasn't much better.

And I heard the roads are the worst in 30 years this year due to the snow / melt / snow / melt / snow / melt - 10 degrees - 45 degrees - 10 degrees winter you guys are having.

Default Well if you were on a bike you would have killed yourself.

Then someone would sue. Unless of course they could prove you were doing 55mph in a 20mph.

Default I think the city has to have been notified of the pothole first

And that's where there can be some vague issues... had they been notified? If they say no, then how can you dispute... know what I mean?

Default i have.. and have not..

i hit a pothole on 84 east in hartford, ct and filed a claim with the dot (dept of transportation).. they said 9 weeks before the insurance company will get a hold of me.. it still hasnt been 9 weeks yet

best thing i did was file a report with the state police minutes after it happened. i took pics of it right away and the next day went and took pics of the pothole (its been filled now so its not good to delay!). i then filled a report with the dot (who had forms on hand for this instance). i attached the police report, pics and a lengthy explanation and a invoice for the new rim i got from force5auto. i also explained that i will be doing a quote from a audi dealer once they actually say they will take my case. which means when they contact me i will then take the car to the audi dealer to be inspected, (because its making suspension noises).. why i waited for the inspection is because the damage is getting worse on the suspension and im not goig to be held liable for that.

granted ill probably have nothing happen and ill have to pay for it myself.. but its best to be over-prepared and seem very professional and motivated abou it

Default Good luck with that...and please post results.

My mother tore the front bumper off her 2000 Jetta (again) on a wheelstop at the Glastonbury Library. She is asking the town to pay on the grounds that the wheelstop is too high. While I agree that the fault is 100% hers, I am still hoping they will pay to fix it - so I don't have to :-)

I'll post results in the New England forum.

Default It's very difficult to prove that the city is at fault.

I've tried it as well, and did just what they wanted me to...gave up in disgust.
Sorry about your rims and tires. I know the feeling. I had to borrow a buddy's car and drive 200 miles to get my spare set of wheels and tires, as it was Sunday, I was out of town, and I blew out two tires and a rim.

Might as well try. You never know.

Default Those Jettas are so low. We just replaced an engine in ...

a 2001 Jetta VR6 last month that was bottomed out and broke the cast oil pan. Unfortunately they kept driving it. :-( So sad.
