Default Copyright Thread

The copyright thread below is locked but I thought a reply is in order.

I practice copyright law in the Bay Area.

Without getting into stech's analysis, it is highly fact driven whether or not the work is actually proper subject matter for copyright. A quick check on Westlaw shows that the subject is extraordinarily complex, fact driven, with an outcome that may or may not support copyright protection.

For those with Westlaw, I would point to the very long analysis in the book:
Copyright Law Protection and Practice, Revised Edition
2001 Cumulative Supplement NO. 2
Author: John W. Hazard
Chapter 2.06 [25] Numbers.

An excellent analysis but one could not even begin to make a determination whether these parts numbers in and of themselves are copyrightable without getting ahold of the original materials.

Default I'm curious...does ownership of a product that is a composition of hundreds of parts, each of

...which has a number that I might need to repair the product, have any impact on the copyright protection of the information? Let's just say that, in general, a copyright applies, but I own a car made up of all of these parts and I need those numbers to repair it properly. Is there any kind of ownership of that number information implicit in my purchase of the product? Just curious.

BTW, please let me know if I've not made my questions clear so I can attempt to express it in another way that is equally unclear.

Default I don't believe so.

But there might be an implied license to use the part numbers in a limited manner--to effect the repair of your car.

No. That "use" of the part numbers does not voilate the Copright Act.

Default one comment re. some answers to stech's post...

... who pointed out "poor grammar" or "translation from sanskrit" etc. Not all the members of this forum speak English as their first language. Some of us have to make an effort to communicate with you guys in your language. I know I make mistakes in English, and now I'm nervous that some people are going to read my posts and think "this guy is a fool, he can't even write english right!". I think it's a very ethnocentric behavior and I resent that. I'm sorry but I took offense at those comments.

Default Merou, the point of pointing out his poor grammar was thus .. .

He was purporting to be an investigator for a company that produces the ETKA disks for Audi and other companies. If he were in fact such a representative then as a matter of speaking for a corporation his post should have been written in such a manner as to have been proof read and sent through a spell check and grammar checker.

Nobody makes fun of anyone else if English is not there first language. We have people born and raised in this country with multiple college degrees who could not spell there way out of 3rd grade, and many of them are on this forum! lol

Hope that clears the air a bit.

Just look at how GuilTTy spells violate, and he is an attorney, supposed to be failry smart, but can't spell worth a damn! lol

I am the first person to point out that there and their are my biggest problems in writing. Just ask Denny and Jason, we have laughed at me about that one many times before.

As for they're, I never screw that one up, too simple! lol
