Strange shifting

Hi Folks, I'm new to this forum and have searched to find a similar problem but didn't find one so I'll ask for help. I have a 2008 A4 Quattro convertible with 50K miles. About the same time that the ESP light stayed on it won't up shift from 1st to 2nd after it has just been started. I can go from auto to manual and it goes right into 2nd and 3rd and then I move it back into auto and it shifts fine up and down as long as it doesn't go back into 1st, in which case I have to move it to manual again. However, after about 10 minutes it works fine in auto from a dead stop in 1st all the up and back down and continues to work fine unless I turn off the engine, in which case it won't shift out of 1st again, even if the engine is hot.

I just bought a Cen-Tech OBD II & CAN Scan Tool (not that I know how to use it right) but it didn't pull and codes, so I don't really know where to start, and I'm not sure it will work with my car since the CD that came with it says "suitable for WINDOWS 7, VISTA and XP, ugh.

Any help would be greatly appreciated.
