insurance company quoted me for a *reconditioned* bumper
Do I have to accept this? I kinda want a NEW one since the one on my car wasn't reconditioned...I'd like one new from the factory...

nope... your car is a 98.. you get a bumper from a 98
its only fair.. they repaint it though... should make much of a difference anyway. They only have to replace with OEM if the car has less than 5k miles on it. (in texas)

Not true...
depending on the type of damage to the bumper, many insurance companies will insist that new parts be ordered. If say you have a rear quarter panel that is dented, you can have the option of pulling it out, bondo-ing it and having it repainted, but most insurance companies will insist that it be replaced because they don't want the customer complaining later. Some insurance companies will even insist the bodyshop to cut out a giant hole in the side of the panel being replaced just to make sure it was actually replaced and not just fixed and having the bodyshop pocket the difference.

but he said that they were giving him "reconditioned parts" i.e. parts from another a car that are repainted. thats what state farm always told me.. i even have a little pamplet here.. "how reconditioned parts are as good as new"

i don't think so...
you really don't have much say in what the adjuster gives you. i had damage to my front and rear bumpers from a hit and run and the damage was imho enough for a new bumper.. but what did the state farm adjuster say? repair it. i told the adjuster and my insurance agent that i wanted a new bumper and that i was entitled to a new one given the damage and the opinions of several bodyshops. but it was the adjusters final decision and i had to settle with money only for repair and refinish.

Which means they're willing to reconsider things, he has a good shot of gettin the extra cash.
