Default Thanks for the thoughts, but.....

They have a crystal clear photo of me behind the wheel to begin with. It is printed on the citation for my enjoyment! Also, the way the law is written, there must be an officer present in the photo-radar van who makes duplicate notes on each infraction. So there is an attending officer who provides the testimony. Also, they must post a photo-radar trap warning sign from 100 to 400 yards ahead of the trap and also a sign stating you have passed through a photo-radar zone after the trap. They have the bases covered. We tried to fight one unsuccessfully with my father-in-law last year, but only were successful in getting the bail reduced.

If the owner of the vehicle is not driving the car when the citation is given, then it gets thrown out. All you have to do is prove you are not the one in the picture.

Our only hope is that the state legislature does not go forward with the program. There is much opposition to it and the politicians are aware of that. Our state Supreme Court has refused to hear any cases relating to photo-radar until the 5 year test is over and the legislation is acted upon.
