It won't mess up your mileage.
The dealer puts in the correct mileage when they code it. And so no issues on the title. That's why I figured for $60 (or whatever his dealer charges him) he could be fixed.
Searching the forums in AW has always been a huge help to me. Especially when there are common issue's like this one. Although I'm sure they have also pointed me in the wrong direction at times as well. I chalk those up to preventative maintenance.

Technically, the cluster won't allow itself be recoded if it has more than 100 kms on it. It's a technical limitation. So the dealer physically won't be able to recode.

My dealer set my mileage on 2 different used clusters.
My RS6 cluster came with 60K on it they programmed it to 140k. (which I was hoping they wouldn't) And my A6 used cluster had 200k on which they brought down to 140K. (Which was very nice of them)
I was a licensed inspection mechanic in NY & currently am in PA. Never heard of any such laws.
The dealer didn't even bat an eye....took care of it in less than an hour.

Ross-Tech agrees. On their page regarding cluster swapping. See the last sentence.

[Adaptation - 10]
Enter "channel number" 09 to select channel
Put in the number of km divided by 10. Example: If old cluster had 50,357 km, put in 5036.
Note: Some clusters may require a Login of 13861 before you can set the mileage.
[Test]
Observe the Instrument Cluster and make sure the mileage displayed is correct. Once you save this value, you will be unable to change the mileage EVER!

Generally illegal only if you deceive as to the mileage.
Most states if not all have a disclaimer where you state the mileage on the odometer is not the actual mileage.
Intent to deceive is extremely difficult to prove....

Just my personal experience
I don't know how they did it. The service manager is a friend, he didn't mention anything special was required. But he is a friend so it could have been.
They where worried about the RS6 cluster working properly in the A6, but it functions perfect.
