If he wants to get on the list now, figures the price increase will be nominal and is willing to pay it, can already drive a nearly identical car now, and can back out of the deal later, why not?

Indeed. Lots of reasons going into this -- pricing was agreed on, but there's no contract, etc, other than a non-refundable $1k. Worst possible case I lose that deposit, but I am inclined to trade my S3 for a lot of reasons. There's always room to negotiate on the trade value as a proxy for the actual vehicle price anyway.

And it's highly unlikely that that'll happen. I got out of my "non-refundable" deposit without much of a fuss, and there are lots of legal loopholes that you can present (like changing the deal, finding out new information about the car, etc.) that give you backup if comes to that.
