I need some advice on an insurance question
This is what happens last night. Driving straight through an intersection, on the opposite direction a guy makes a left, does not wait for me (I have the right-of-way) and takes me off! I'm driving my parents' car, on which I don't have coverage, they do. I have a separate policy on my AR with the same company. Now, on their car they only have liability, no collision coverage, so the insurance company tells me that they won't total the car (it's undriveable and will cost more to repair than what the car is worth) and will not seek to get compesation from the other guy's insurance. So, what are my choices here? Do i have so sue the other guy (his insurance) in order to get compensated? How do I proceed from here?

Not sure how many Lawyers are here to give some advise but in this case a Lawyer would be my choice.
Usually the initial conversation doesn't cost anything, lay out the facts and get some advise.
As you know....getting a descent Lawyer is like going shopping.....most times you'll have to compare what's worth the money.

What insurance carrier? Might want to discuss with your agent, if you have one....
First of all- was everyone OK? That's most important.
Was the other guy cited by police for being at fault? If so, go after his insurance, if he has any. If not, why not. May need a copy of the police report.
With my State Farm policy, insurance coverage follows me in whatever I'm driving.

Thanks Tom, I do have a good lawyer, but was looking to see if there might be any other alternatives
out there... I guess I'll talk to him tomorrow...

I am OK, thanks Ed, just bruises on my shoulder from the seat belt and a little burn on my jaw from
the air bag. I haven't seen the police report yet, as I was told it would be ready on Friday, but I bet the other man/woman was cited at being at fault, since it was a hit-and-run, and I never saw who was driving the other car. A witness took off with his car after the guy tried to drive off, and was able to get his plate number. I hope they find him and I hope he has insurance...

If the Insurance company doesn't seek compensation then what choices are left?
Someone has to pay the bill, even though they don't want to total the car. And it souds like that the Insurance company isn't on your side either.
These were just my thoughts towards a possible solution because it appears that you are pushed into the corner.
Hey, this country is based on lawyership, right? So take advantage of it while you can ;-)

There's been a development...(long)
So I get a call from the ins. co. yesterday, saying that they can cover it under my policy (doh). The lady didn't seem very knowledgeable to begin with, so like Ed said that his policy follows him in any car he drives, I started thinking about it and it made total sense, since I've always declined insurance when renting a car, but was still covered under my own policy. Ed, you were right... So she calls me last night, after I spoke with my lawyer, who by the way recommended that I show recent repair bills (if any) to show added value to the car so that we can get reimbursed for those as well, and it so happens that last year the car got new front struts and mounts and new tires, so we'll see.
BTW, I got the police report yesterday, the guy had no driver's license and was caught and arrested. The car is registered to a relative of his (same last name), and it has insurance, so that's good! Let's hope this thing gets resolved ASAP.
This is what happens when you get hit driving with 30mph by an oncoming car!

Holy s#@t, that's pretty major damage! Glad it's going to work out. Don't forget...
two things:
1) make sure if your insurance pays out initially that they subrogate with the other insurance company for their money so you don't get hit on your record for the damages.
2) did you go to the hospital or a doctor? You'd said you had bruises, so might want to just in case.
maybe I missed it in one of the threads, but what kind of car was that? And are you inferring that the insurance company wants to total it?

2. At the time of the accident I was offered by the ambulance personnel to go the the hospital, but I was feeling OK, so I opted not to. I might go see a doctor though, like you said, just in case.
It's a 1997 Toyota Camry V6, great car, had 94K miles on it, and the engine was sooo smooth, and it was virtually a trouble-free car.
As far as the ins. co. wanting to total it, they haven't seen the car yet, but i'm sure that it's going to be totalled.
Well, the guy got arrested, and whomever his car belonged to will not get money for his damages and have to look for another car as well, probably face much higher insurance premiums, but you're right, wrong time, wrong place and headaches for me and my folks...
