Default Ticket Question: A friend got a ticket from the Port Authority Police on the GW Bridge.....

A truck side-swiped his car on the GW Bridge and they pulled over.

The Port Authority police arrived on-site immediately and said they had a witness saying my friend was on his cell phone when it happened.

My friend says he wasn't and tried to give his statement/side of the story to the cop and the cop wouldn't listen him.....blah...blah...blah...

My friend ends up in an argument with the cop and gets a ticket for "Failure to Comply with an Officer - Statute #39.4-57" - Basically he told my friend to get back in his car and he did once the cop threatened him with arrest.

No tickets for the accident...just the Non-Compliance issue.

Question:

This is a two-point offense according to NJ.

Does this carry over to my friends NY License if he is found guilty? He has a court date to fight this. He just want's to know what will happen with his license/record.

BTW - Ticket says "Municipal Court of Fort Lee, NJ"

Default just go fight it, when you show up try to see the prosecutor,

and explain to him the incident. Good luck.

Default I told my friend he should ask for a "Continuance" as that helps with the chance....

that the Officer won't show up. Worked for me.

They uusually schedule the initial appearance date based on the cops schedule. A Continuance can be any random date there after.

Default NY, NJ and CT all share information

but the key thing is that unless your insurance company queries the database, and they don't very often, then your insurance won't be affected.

Default Any chance it was the truck driver that called in reporting your friend

talking on the cell? I'm thinking he might have gone back to the truck after the accident and made that report just to get off the hook for the accident. These guys drive for a living. They can't afford to rack up points for accidents, speeding, etc.

Anyway, the point is, if the insurance company tries to verify the "witness story" hopefully it will lead to a dead end.

As far as the failure to comply...explain to the prosecutor that you were trying to explain your side to the cop and he wasn't listening...and eventually he did go back to the car as requested. The ticket was completely unnecessary. Obviously it's important how your friend conducts himself during this explanation. If he raises his voice, just a tad, he'll probably get stuck with the ticket.

Default No Chance...he said the police were right on the scene after it happened.....

Basically, someome drove by, rolled down their window, and told the cop my friend was on his cell phone.

The one thing my friend had against him is he is from the Ukraine and has a heavy accent. I think the cop was probably a little biased against him.
