Default need advise:2012 or 2013 q5?

start off by saying hello, first post. I need advise please help.
Story:
4 weeks ago i traded in my 09 BMW 3-series converible for 2012 Q5 3.0. While our Q5 was on order, they let us use a brand new A6. We sign the contract and everything but it wasn't completly finish because we didn't have a vehicle for 1 week. When we recieved our Q5 and drove it back home, Audi called and told us we need additional information. My question is that if i return the 2012 Q5 and wait to get 2013 Q5 would i be penalized. They told us the bank is not approving it and they need additional infomation, so therefore, the contract didn't go through, right.(Bank needed the address where all mail go to but on the contract i put down the address i'm staying at). thanks for listening and tell me what i should do

You wont see a 2013 "Model" until July of next year. Thats a bit of a wait. 3.0? Thats a TDI model, bet you are referring to the 3.2 FSI.
Its just the 2013 3.0 TDI would hit you a bit earlier in EU.
Either way the model year wont change with the calendar year.

If the bank is asking for more info, which model year is not the issue. You are either approved or not.

If I am right, its nothing more than technicality, but you already owned the car. You agree to pay a certain amount for the car, rather you get it from this bank or that bank, it doesnt matter.

I thought they are putting the gasoline 3.0T from the Audi A6 into the 2013 Q5 replacing the 3.2 FSI. Will the 3.0 TDI be in addition to the hybrid one?

I gave up on waiting for the Q5 3.0T. Its ashame too, that is one heck of a powertrain. I just bought a 2012 A6, that 3.0T/8 speed tranny powertrain is amazing, 0-60 below 5.5 second on the A6. That powertrain on the Q5 will easily blow away the BMW X3 35i.
