Default There weren't any other witnesses, and I'm fairly positive she doesn't have a license.

I've never seen her drive before in my life, and I know she's in high school. So I'm guessing she's 15 based on the fact that you don't get a license until you're at least 16 in Michigan, and, to reiterate, I've never seen her drive.

I showed him the estimate ($2200), and he -of course- was a little taken aback. He says that he doesn't have that kind of money sitting around (which I believe) and he's actually trying to see if he's still on his old insurance policy. He's not sure when he set his cancellation date as. So he's going to let me know. (I smell something fishy maybe here. I dunno.)

If he starts to give me the runaround, I've already talked to my insurance lady today and she said that the choice is up to me; they will start the claim paperwork any time I'm ready and forward the whole business on to their collections department. I'll be responsible for the $500 deductible when I pick up the car from the body shop, but (although she said no) I'm hoping that if the claims department can get him to pay for the damage, they can get him to pay my deductible, too.

Default You need to call your insurance company now - check your policy but I think

it probably requires that you report every accident. If you don't then they might have more difficulty recovering from your neighbor later, which won't make them very happy. Just report it.

Default I called them earlier. They basically gave me two options:

Work it out with him, or pay the deductible and have them give the policy over to their collections department. I'm going to give him a day or two to tell me if he's going to cut me a check, or just get the car fixed via my insurance company and turn him over to the wolves. As others have posted on this thread, I'm not at fault here and I deserve to have my car fixed up as it was before this douche-pouch drove into it, as soon as possible.

Default true, and agreed, but that doesn't mean you have to act like a total d-bag to him like others below

have mentioned - burning bridges rarely ever result in positive things.

this is just a minor moment in both lives and hopefully both will learn from him, accountable or not, hopefully the 'neighbor's at least a bit shaken with the whole ordeal.

Default This sounds like what the majority of folks here are saying.

It's good to hear it from a first hand source, though. It's probably the route I'm going to take, if only for the fact that I can take my car in right away to get it fixed.

Thanks to you and others who have contributed helpful advice, it's greatly appreciated as my naivety concerning uninsured claims is clearly showing! <attempts to hide> haha.

Default Indeed, too trusting

Jan 2007, a guy down the road hit my older Audi. He says he'll pay me what ever it costs to fix. I took it to Audi, got a quote for $2500 and gave it to him. He's replies, no I'll give you $500... A year later, we're still arguing over the cost.

Good luck, I know I've learned my lesson.
