I do the same thing....
I am creative cunsultant for an online media company... (yes, I design those annoying emails you most likely get) we do alot of "motormillions" pop ups and email creatives.... when I can I use an Audi.... A while back I even used an oettinger B6... The shot fit so I used it....

Of course... I (we) never use images without the rights....
I have a personal image library of thousands of royalty free images which I have purchased, (buy the CD for 1 image and bill the client the entire CD amount) plus I do a ton of my own photgraphy. We also purchse a lot of rights managed images for lower run projects.... In the case I described above, the client wanted an asian family... there were limited selections of an asian family with car, so we shot our own photos... just happened to use a friends oettinger kitted B6 cause it had no badges....

Heh, sweet, we're lining up to do a shoot with...
... a couple dozen cars and models. Illustrate the whole car buying process.

Isn't that the guy competing for the X prize or whatever it is... the first commercial spaceflight?
either way... nice composition... are you a photgrapher or a designer or neither?

Yes, Burt Rutan is going for the X-prize (and I personally think he has the best chance of winning.)
I am a designer by training and an amateur photographer. But now I mostly do Web Application Development.

Do you have permission from Audi to use the likeness?
I ask because I ran into an issue with our Boston Audi t-shirts that the two places I'd talked to refused to produce the shirts with an image of an Audi on it, regardless of the source of the image, without written approval from Audi to use a likeness of one of their vehicles.
If you've gotten that from Audi, shoot me an e-mail and let me know who you talked to there...

Did your picture contain any trademarked or copyright protected material?
We would need a lawyer to get the right answer here, but I don't think that is 100% true.... I have never heard of not being able to use an object because of its likeness or even perceived likeness (in the event of an illustration), unless maybe the shape of the vehicle or object is unique (an example mught be the round profile shape of a new beetle), my question would be, who would make the call and how would you draw the line? The key things I had done at the time was to make sure there were no audi insignias showing... this is exactly why you can turn on the tv and see many automotive adds with "generic" looking cars... But to answer your question, no I didn't, and the company I freelance for never received a cease and desist.
