Default cat codes for CEL came before 80K miles warranty still cover it?

My CEL came on a couple of months ago and I just got it checked, I now know I should have done this sooner. Anyway it was for the catalytic converter, bank 1 and bank 2 or something like that. This is covered by the warranty before 80K miles, but I'm at 79,820. The dealer said they saw the codes and reset them, but can't fix it until/if they come back, and it will only be under warranty if they come back before 80K. Is this right? Seems unfair to me if they were aware of the problem before 80K. Also is there a way to make the codes come back so I can for sure get them back before my next 180 miles?

i would contact audi of america now before 80k and see what they say

Default It came back on at 80045, I was on a trip so by the time I got back it was 80400 something

But they still honored the warranty. Brought it in today expecting to get the cats replaced, but instead after picking it up I was told Audi's procedure for that warranty item is to flash the ECM. Well they couldn't flash it so they put in a new ECM and they said that this should take care of the Cat codes coming up b/c the thresholds were too tight on the original.

My question is if the cats were performing not to the higher effeciancy level how long before they stop peforming to the new ECM level as well?

My codes originally were:

16815 P0431 035
Warm Up Catlyst, Bank 2
efficience below threshold

and

16805 P0421 035
Warm Up Catalyst Bank1
efficiency below threshold.

Also coming up before the reset and after were

17125 P0741 035
Torque converter lock-up clutch
Performance or Stuck Off

I'm more concerned now about the last one, but going to do a new post on it since it is a different code.
