just rear-ended, Please help!

Default just rear-ended, Please help!

I was just rear-ended- my MY01 is only 1 month old!

I've got the guys insurance#, phone#, etc, but didn't call the police. I have one witness. Should I have called the police?

AAAAAAAAAAAAAAhhhh! I'm going to go cry now.

Default Just go to the Police Dept where it happened and file a report....

Clearly state that it was the other motorist's fault. Then go get an estimate to get the car fixed... and call the other guy's insurance company FIRST. Do not call your own insurance company until you get no response from the other insurance company.

This happened to me... when I called the other insurance company, and presented the report, they paid in like 2 days.<p><a href="http://www.rwnewmedia.com/a4/index.html" target="_blank">

When you make a claim against the guy's insurance. The insurance company will contact him to verify your claim.

If he verify's positive, then they should pay your claim. If not, you can always take him to Municapal Court...<p><a href="http://www.rwnewmedia.com/a4/index.html" target="_blank">

Default It helps if the other guy is cited where there may be personal injury and litigation....

Insurance companies make their own determination of fault irrespective of police reports. In some states you aren't required to call police unless there is injury or significant property damage. It helps to have the cops there to determine if the other guy has valid credentials (license, registration, insurance etc). If not, they can throw the rat bastard in jail and at least you'll feel better!

Default If the damage is serious, call. Once you leave the scene, there is nothing else you can do.

I had a reverse rear ender once. A flat bed was backing up at a stop light to turn around and I just didn't think he was going to hit me. How frustrating, I was in shock. I didn't end up calling the police and got screwed on the body work.
