Here is the story with details. I was going to lunch with my friend. We are doing togo at ph changs. The Lime Green trail is our walking paths. So i get to my car (blue) and i back up and go. She walks up to her car and backs up and goes. By the time she backed up im already in the lane across from her.

I stop at the corner and yield. Then out of no where she comes by and hits me right on the drivers side.

The parking lot was packed and there was a tree on that corner.
I did yield and then took the turn.

Now this happened on october 16th. A week after the accident...she got a new car...
Insurance claims took care of the faults and everything. Insurance claims people settled for 60% my fault and 40% hers. It was my fault for fail to yield (psh...) and her fault for speeding. I was ok with that... we just decided to pay for our own damages.

There were no tread marks on that street. There was also no sign of her stopping. Shes a terrible driver and cant keep her eyes on the road.
She drives with her iphone in hand most of the times.
i know,....because i was in her car a couple of times.
That is the story 2 months ago...

Now, i just got out of finals and checked my phone.
Insurance calls and says that her insurance wants to blame 100% my fault.
So they need to redue the claim.
what the fudge?!

ok...so she does go to the same school as me.
Shes spoiled as hell...and...got a new car a week after that.
I was told that parents and my friends know shes terrible at driving.
We are kind of fighting, but its like nothing big...just she makes it a big deal.
Its just stupid drama...

Now after two months they want to bring this up again?

i was told i should get a insurance attorney.

What is she getting out of this?
She already got a new car and i still dont have mine back from the shop yet.



There is no way she can do that much damage in a parking lot.
She was speeding.
She didnt see me.
She totalled her infiniti and my car is with 7000 worth of damage...it keeps going up cause they keep finding more problems...

List of things left to do on my car....
A-pillar
door frame
and reassemble/ paint

what should i do?
get an attorney?
settle it ?

oh and to add that if i do take an attorney on this,i hit my head on the window when my car was hit. I had a lump for a week
It was a pretty bad lump/ bruise.
She walked away from the accident without a scratch.

People say she ment to hit me on purpose and to back that up...shes not letting this go at 60 / 40.
So now they are bringing it up again and wants 100 my fault.

it sounds like its the insurance company thats "getting something" out of this, not her. That is quite a bit of damage for a parking lot accident, unless she was speeding or didnt brake - in which case shes at least partially liable...

youre gonna need an attorney to help you prove that.

 

In addition, your insurance company should be fighting on your behalf (I'm not sure why they're not). If everything is said and done, then there should be no way that this all goes back around again. If she agreed to fault, she can't just go back and say, no, actually, I changed my mind...

i just did a sworn statement today with my....idk what to call him....
so this case will hopefully be settled on feb 10th

so i go on with life and just hope i get my car back to how i want it...
