Honda Ruckus: Considered MOPED in Mass?

I'm looking to purchase one and on the MASS RMV Requirements site:
According to Massachusetts law, a moped is a "motorized bicycle." In order to be classified as a moped, the vehicle must:
-Have a cylinder capacity of no more than 50 cubic centimeters.
-Have an automatic transmission.
-Be capable of a maximum speed of no more than 30 miles per hour.
-Comply with all applicable federal motor vehicle safety standards.
I know that it is 49cc but believe it runs more than 30mph
Just wondering if anyone has experience with this.
And by:
Mopeds will not be operated:
By any person under 16 years of age.
By any person who does not have a valid license or permit.
At a speed greater than 25 miles per hour.
Without the operator and any passenger wearing a DOT standard helmet.

yes.
They are mopeds. you do not need an MC license to drive one. You do register it and get a little sticker though.
The Yamaha C3 and Zuma are good alternatives as well.
The Zuma is friggin FAST too. 49cc TWO stroke. Gets about 123mpg
The Ruckus has lots of cool mods though

I really want one. just debating commuting from Salem to Revere every day on one.

Extra large rear tire, stretched frame, 125cc motor (normally a 2 stroke)
They make enough power to do burnouts.
It's a 10x8" wheel... it's wider than the wheels I've currently got on my S6
