did you end up getting security camera footage?

my sister just got into an accident in NYC, sounds like the exact situation as you. she was just sitting still, and a construction van backed into her. he is saying that she rear ended him!!

i told her to look around for security cameras and witnesses. the guy is screaming at her right now, i told her to stay in the car and call the cops.

what happened in your situation? what advice you got?

make sure she tells the dispatcher that she feels threatened that will bump it from a code 1 to a 3... if this guy is really screaming at her

multiple times for that day and time I gave them but they couldn't see anything. The last time I spoke to them, they said they were going to play the tape in slow motion to see if they can get anything. If they haven't found anything by now, I'm guessing they won't.

I asked what happens if they can't prove fault, especially with no tape, it's my word against his. Usually if both ins companies can't agree on fault, it'll go to arbitration and they try to come to an agreement, usually 50/50 fault, so no one is blamed, no points, no deductible out of pocket.

If the outcome is not in favor for you, you can appeal the decision however I hear this is a long process. If you're assessed points, you have to pay the premium with those points and if you're found not at fault after appealing, you get the money back that you've paid in that time period for those extra points.

Its a crap situation. I feel for your sister. Try to find any witnesses, look around for cameras (as you've instructed her already), etc. Anything that can help her prove they backed up into her. Otherwise, it is really a he said/she said kind of case.
