Default Will a citation for passing in a no-passing zone hold up in court...

if it was reported by a civilian, and the officer didn't see the infraction?

When I wrecked my motorcycle a month ago I received such a ticket. Apparently a driver's ed teacher said I passed him and then promptly proceeded to wreck a few turns up ahead where he couldn't see. I don't remember any of what happened before or after - I suffered some fairly serious injuries one of which was a nasty bump to the head.

Nobody actually witnessed the accident.

Sounds like I deserve the ticket - I'm just curious if it's winnable or not.

Default Wife just went through this with a "too fast for conditions" ticket.

As long as you didn't admit it to any cops, and as long as the ticket is unrelated to determining fault in the accident, they probably will not prosecute it. IF they do, it won't stick - there are lots of ways to attack it. For instance, if he lost sight of you for even a few seconds, how can he be sure that it was the same rider?

Default Yeah, I remember you telling me that at the last meet...

Maybe it'll get a lawyer for this? I think it may be worth it.

Default Not sure how it works in Mass. In CT you just meet with the prosecutor...

...first time in, so you can hire a lawyer later if need be. Given that you crashed around the corner, you probably will need help to escape this one.
