My guess is that if you sue you can get them to cover some of your expenses. Most companies will settle out of court. I know HP (never publicly) did this in the old days (now gone)

I would think that they would at least be willing to talk about it. They must really be worried that you won't be granted the clearance. In that case, they're looking out for themselves financially. Last I heard, a clearance costs around $60K to investigate and that was a several years ago.
