Has anyone in Virginia smoked their tail lights?

The guy that inspected my TT this morning said he didn't think it would be legal. Just wanted to get a second opinion though.

Hi, I'm in Richmond myself and have tinted rear taillights on another vehicle. I had an argument with the inspector and contacted the State Police who happened to clear the matter. It does'nt matter how tinted the lense is, just how much light shows when necessary. This is what I was told.....
