Default 82 in a 65 in VA = Perfect End to Bad Day ... help...

Any ideas how to bring this down. Supposedly, anything over 80 in VA is considered reckless. Going down 81S and damned state cop clocked me. Court date, Feb 04 ...

Need ideas on how to approach this. I don't care about a ticket, I just don't need the reckless driving portion. Lawyer? No Lawyer? Guilty? Not Guilty?

Did he clock you at exactly 2 mph over the reckless driving limit?

In jersey you can ask to see the radar gun, upon getting a ticket, to see if they are lying.

Default I live in VA and I thought 20 over was immediate reckless

At any rate, I had a similar situation once before. From my understanding unless the cop opts not to write you for reckless (it's in his discretion), then there's nothing that can be done in court. If you do go to court, please don't plead not guilty. You were guilty. Regardless of your intentions or reasons, you were guilty of exceeding the posted speed limit. You can plead guilty with an explanation.
However, going to court in VA is as good as useless. You end up paying more because of court costs.

I got stopped one time years ago for doing 100 in a 55 down the Dulles Airport Access Road. I was late in picking up my bro's family from Dallas and I wanted to see if the wind deflector thing on my windshield wiper really worked at high speeds. Yes it was raining. This was years ago when I had my Jetta. The cop paced me from the Toll Road part (Route 267) that runs parallel to the airport access road. He sat in my blind spot. He merged on to the airport road and stopped me. Through my magic, I managed to talk him down to 85 in a 55 and NO reckless. VA judges however are not nearly as lenient.

Default He is correct

80+ in Virginia is wreckless, but it up to the discretion of the police officer. I once got a ticket for 83 in a 65, was warned that it was above the 80 limit but was not given wreckless.

Even if you are speeding by less than 20mph you can be given wreckless if the officer thinks you deserve it.

BTW - I went to court, pleaded guilty and got off.

Default Based on what I've read on these forums...15+ is wreckless, and

every mph over 20 is a day in jail + the wreckless charge. I could be wrong though...I've never had the inclination to speed in VA since I've learned about this.

I was going 25 over limit in VA once...cop wrote me for only 19 over so it wouldn't be reckless.

Default I got the same exact ticket, 82 in 65, but....

this was in NH and I got a $150 speeding ticket and like a point or two on my license. VA is worse, they make you go to driving school and court!
